AAA Expresses Deep Concern Over Court Ruling Allowing Termination of TPS for Ethiopians

The Amhara Association of America (AAA) is deeply disappointed by the August 18, 2026 ruling by the U.S. District Court for the District of Massachusetts which made way for the Department of Homeland Security to terminate Temporary Protected Status (TPS) for more than 5,000 persons of Ethiopian origin residing in the United States despite ongoing war conditions in Ethiopia.

The premise underlying the termination, that conditions in Ethiopia no longer pose a serious threat to returnees, is contradicted by the reality on the ground. Ethiopia remains a country at war. The Amhara Region and surrounding areas have endured armed conflict since 2020, marked by drone strikes on civilians, extrajudicial killings, sexual and gender-based violence, mass arbitrary detentions, and the collapse of healthcare and education for tens of millions of people.

Beyond the Amhara Region, ethnic Amhara and Christian communities continue to face targeted attacks, displacement, and systematic persecution in Oromia Region and other parts of the country. These are precisely the conditions TPS was created to address. For TPS holders from these communities in particular, return is a real danger, as their ethnic identity and faith alone places them at risk of detention, displacement, or death.

AAA notes that the court allowed the plaintiffs ' claim alleging racial and national-origin discrimination in the termination decision to proceed.

AAA stands in solidarity with continued challenge led by affected communities and urges the courts to fully examine whether this decision reflected discriminatory intent rather than an honest assessment of conditions in Ethiopia.

AAA urges the administration to reassess country conditions in Ethiopia, calls on Congress to exercise oversight of this decision, and urges that no removals proceed while war and ethnically-targeted violence persist and litigation remains unresolved. Sending vulnerable people back into an active war zone is inconsistent with both American values and the humanitarian mandate of the TPS statute.

AAA stands with affected TPS holders and families affected by this decision, and will continue to document conditions in Ethiopia and advocate for protection of vulnerable communities.

በኢትዮጵያ ውስጥ ያለው የጦርነት ሁኔታ በቀጠለበት የአሜሪካ የሀገር ውስጥ ደህንነት መሥሪያ ቤት በአሜሪካ የሚኖሩ ከ5,000 በላይ ኢትዮጵያውያንን ጊዜያዊ የከለላ መብት (TPS) እንዲሰረዝ መንገድ የከፈተውን የነሐሴ 12 ቀን 2018 ዓ.ም. የአሜሪካ የፊደራል ማሳቹሴትስ ዲስትሪክት ፍርድ ቤት ውሳኔን የአማራ ማኅበር በአሜሪካ በጽኑ ይቃወማል።

ስረዛው የተመሠረተበት “ከእንግዲህ በኋላ በኢትዮጵያ ያለው ሁኔታ ለተመላሾች አሳሳቢ ስጋት አይፈጥርም” የሚለው እምነት በሀገሪቷ ላይ ካለው ነባራዊ ሁኔታ ጋር የሚጋጭ ነው። ኢትዮጵያ አሁንም በጦርነት ውስጥ ያለች ሀገር ናት። ከአማራ ክልልና ከአካባቢው ጋር ተያይዞ ከ2012 ዓ.ም. ጀምሮ በጦር መሣሪያ የታገዙ ግጭቶች ሲካሄዱ የቆዩ ሲሆን፣ በንጹሃን ዜጎች ላይ የተፈጸሙ የሰው አልባ አውሮፕላን ጥቃቶች፣ ከሕግ ውጭ የሚፈጸሙ ግድያዎች፣ የፆታና ብሔር ተኮር ጥቃቶች፣ እስራትና የጤና እና የትምህርት ስርዓቶች መፈራረስ በአስር ሚሊዮን የሚቆጠሩ ሰዎችን ጎድተዋል።

ከአማራ ክልል ውጩ፣ የኦሮሚያ ክልልን ጨምሮ በሌሎች የሀገሪቱ ክፍሎች የሚኖሩ የአማራ ብሔር ተወላጆችና ክርስቲያን ማህበረሰቦች ጥቃት፣ መፈናቀልና ስልታዊ እንግልት ይደርስባቸዋል። እነዚህ ሁኔታዎች ጊዜያዊው የከለላ መብት (TPS) ሊፈታቸው የተቋቋመላቸው አሳሳቢ ጉዳዮች ናቸው። በተለይም ከእነዚህ ማኅበረሰቦች ለተውጣጡ የቲፒኤስ (TPS) ባለመብቶች ወደ ሀገር መመለስ ትልቅ አደጋ ነው፤ ምክንያቱም ብሔራቸውና እምነታቸው ብቻ ለእስራት፣ ለመፈናቀል ወይም ለሞት ሊዳርጋቸው ይችላል።

የፍርድ ቤቱ ውሳኔ ዘርንና የመጡበትን ሀገር መነሻ ያደረገ አድልዎ አለበት በማለት ከሳሾች ያቀረቡትን አቤቱታ እንዲቀጥል መፍቀዱን የአማራ ማኅበር በአሜሪካ ይገነዘባል።

ማኅበሩ ጉዳዩ በሚመለከተቸው ማኅበረሰቦች የሚመራውን የሕግ ትግል የሚደግፍ ሲሆን፣ ፍርድ ቤቱም ይህ ውሳኔ በኢትዮጵያ ያለውን ወቅታዊ ሁኔታ በትክክል ያልገመገመ አድሏዊ መሆኑን በጥልቀት እንዲመረምር ያሳስባል።

አስተዳደሩ የሀገሪቱን ሁኔታ በድጋሜ እንዲገመግም ማኅበሩ እያሳሰበ ኮንግረስ በዚህ ውሳኔ ላይ የቁጥጥር ሚናውን እንዲወጣና ጦርነትና ብሔር ተኮር ጥቃቶች በተንሰራፉበት ሁኔታ የሕግ ሒደቱ ሳይጠናቀቅ ምንም ዓይነት የማባረር እርምጃ እንዳይወሰድ ይጠይቃል። ተጋላጭ የሆኑ ሰዎችን ወደ ጦርነት ቀጠና መመለስ ከአሜሪካ እሴቶችም ሆነ ከቲፒኤስ (TPS ) ሕግ ሰብአዊ አላማ ጋር የሚቃረን ነው።

የአማራ ማኅበር በአሜሪካ በዚህ ውሳኔ ከተጎዱ የቲፒኤስ (TPS) ባለመብቶችና ቤተሰቦቻቸው ጎን የሚቆም ሲሆን፣ ኢትዮጵያን በተመለከተ መረጃ መያዙን እና ለተጋላጭ ማህበረሰቦች ጥበቃ እንዲደረግ ማሳሰቡን ይቀጥላል።
